Govt Launches Consultations to Bolster Anti-Sexual Abuse, Harassment Law

The Ministry of Social Affairs and Family Development has commenced critical consultations aimed at amending and strengthening the existing Prevention of Sexual Harassment and Abuse Act.

This law, which provides vital protection against sexual harassment and abuse in workplaces, educational institutions, health facilities, and social service settings, is now the subject of a comprehensive review intended to boost its efficacy.

Speaking at the opening of the consultation meetings, Minister of State for Social Affairs and Family Development, Aishath Zuhurubaan, stressed that the primary objective of the endeavor is to reinforce the legal framework in collaboration with relevant agencies. Zuhurubaan confirmed that local law firm, Alifu Law Chambers will play a significant role in guiding this legislative strengthening effort.

"The main purpose of this is to ensure that employees working in educational institutions, workplaces, social and service institutions under this Act are safe and secure," Zuhurubaan explained, expressing hope that the review process would be accelerated.

The Act currently prohibits any form of sexual harassment or abuse perpetrated by an employer or colleague against any person within the workplace. Existing provisions mandate prompt investigation of complaints, requiring the respondent to receive a written notice to immediately cease such behaviour.

Additionally, the law stipulates measures such as the restoration of any rights lost by the complainant due to the harassment, and provides mechanisms for compensation for damages incurred as a result of the abuse.
