Judicial Service Commission (JSC) has withdrawn the suspension of former Magistrate at Maamigili Court Ahmed Nihan.
Former Magistrate Nihan was found guilty of issuing a falsified court order for the arrest of then President Abdulla Yameen Abdul Gayoom. The state raised terrorism charges against Nihan and Criminal Court sentenced him to 17 years in prison.
The Criminal Court verdict said Nihan had assisted in unlawfully breaking into the Maamigili Court, and issuing a falsified court order with the intention of exerting undue influence on the state. The verdict also read the perpetrators had conspired to kidnap President Yameen to provoke fear in the public, amongst other charges. It also detailed how witness testimonies proved beyond reasonable doubt that Nihan had accessed the court after midnight on February 7, and prepared the falsified court warrant.
However, High Court overturned the Criminal Court verdict last November. Prosecutor General's Office said the case would not be appealed at the Supreme Court.
JSC suspended Nihan over the case during 2016. JSC revealed despite the suspension lift, Nihan's disciplinary issue will be investigated.
