Supreme Court of Maldives has declared any action taken by Judicial Service Commission (JSC) against Supreme Court Judge Abdulla Didi would be invalid.
In a statement, the top court of Maldives said any action taken by JSC or any other authority would be invalid, as it has issued a stay order on any action against Judge Abdulla Didi. The Supreme Court noted it is a duty of the courts of law to ensure justice is delivered and as the highest court, it has the authority to ensure justice as per the constitution.
The court also highlighted JSC does not have any mandate to overrule a court order or a ruling. Therefore, the Supreme Court said JSC not following the boundaries set in the constitution is a clear violation of the mandate of the commission.
The Supreme Court issued the statement in the wake of JSC maintaining that the suspension of Judge Abdulla Didi is in place despite the Supreme Court order not to take any action against him.
