JSC decides not to follow Supreme Court order on Judge Abdulla Didi case

Judicial Service Commission (JSC) has maintained the suspension of Supreme Court Judge Abdulla Didi is in place despite the Supreme Court of Maldives ordered not to take any action against him.

In a press release, JSC said the stay order issued by the Supreme Court earlier today obstruct the constitutional and legal rights of the commission and therefore has decided not to abide by the order.

Earlier today, in a statement, the Supreme Court said a case was filed by the judge in question as JSC had suspended him on Wednesday in regard to a case filed against him by Speaker of Parliament Mohamed Nasheed. The case filed by the speaker was in violation of the constitution, the Judges Act, Judicial Service Commission Act and other related laws and legal procedures, Judge Abdulla Didi mentioned in the case filed at the Supreme Court.

Therefore, the Supreme Court ruled that no action must be taken against Judge Abdulla Did as his case would be heard at the superior court.

On Wednesday, in a press conference, acting Secretary General of JSC Hassan Zaheen said Judge Abdulla Didi was suspended as Maldives Police Service was investigating a case against him. Zaheen added the case was submitted to JSC by Speaker of Parliament Mohamed Nasheed. The judge was suspended with majority of the 10-member commission voting in favour.
