The Attorney General's Office (AGO) has stated that there is no obstruction to holding the swearing-in ceremony of President-elect Dr. Mohamed Muizzu. The AGO made the statement at the first Supreme Court hearing on the Constitutional case regarding the stalled no-confidence motion against Speaker of Parliament Mohamed Nasheed.
The AGO is representing the Secretariat of the Parliament in the case. At the hearing, State Attorney Fathimath Khaleel said that the case is not obstruction to the swearing-in ceremony as there is no reason that the issue should halt parliamentary work. She made the statement in response to a question posed by the presiding judge regarding the responsibilities of the Deputy Speaker.
The AGO argued that only the Deputy Speaker can preside over a no-confidence motion against the Speaker, despite Article 44 of the Rules of Procedure of the Parliament stating that the Speaker shall appoint the longest serving member to preside over a sitting in the absence of the Speaker and Deputy Speaker, in accordance with Article 82(b) of the Constitution. The AGO stated that no other member can take over the responsibility of the Deputy Speaker.
