Anti-Corruption Commission (ACC) has resubmitted a case against two officials of Fenaka Corporation Limited after making amendments as instructed by the Prosecutor General’s Office (PGO).
ACC requested the prosecution of former Deputy Director Ismail Shammoon and current Deputy Director Ahmed Najah for making a payment to a private contractor to develop a billing software in violation of the established regulations. The agreement stipulated that the contractor finish development by November 6, 2017, but Fenaka is yet to receive the software.
However, Shammoon and Najah had submitted a signed document claiming that the project has been completed in order to pay the contractor, which violates Section 513(b) of the Penal Code pertaining to their misuse of authority as a public official for the purpose of obtaining a benefit for another party to which they are not entitled. They had also violated Article 12(a) of the Prevention and Prohibition of Corruption Act by using their influence as an employee of the government to confer an undue advantage pertaining to a task being carried out by their place of employment.
ACC has also instructed Fenaka to recover USD91,000 paid to the contractor.
