The Judicial Service Commission (JSC) has decided to take disciplinary action against the Chief Magistrate of the Lhohi Magistrate Court Ahmed Hassan Manik following the conviction of his charges.
In the case investigated by the JSC showed an interim order at the request of the plaintiff in a custody case. It is stated that a child in the custody of the defendant was taken into the custody of the plaintiff. The investigation revealed that the summons could not be served on the given address as the plaintiff had left the island without obtaining the permission of the court.
Furthermore, JSC did not consider the results of the measures taken by the court without seeking the statement of the accused, and the interim order was quashed by the High Court of the Maldives. JSC has also ruled that the case cannot be continued and has, therefore, proved that the plaintiff has received an unfair advantage from the judicial system.
The action is contrary to the Code of Conduct for Judges and Chief Magistrate Ahmed Hassan has been directed to complete a training programme prescribed under the JSC Act.
