Court rules allocation of land from Eydhafushi illegal

Eydhafushi Magistrate Court has ruled that the allocation of land plots in Eydhafushi in Baa Atoll has been conducted in violation of the established regulations.

The court issued the ruling following a petition filed by a private party seeking recovery of deducted points alleging that points were not given to the items on the form as per the advertisement for the allocation of residential land plots in Eydhafushi.

The court held that the respondent's statement proved that the Vilares Committee formed to assess the application forms of the applicants for land plots in Eydhafushi had acted in violation of the established regulations. The court said the regulations followed by the accused to award points in the island residence section were invalid as the points were awarded illegally. The court said the regulations were invalid because it was proved that the committee had not publicly announced the incorporation of the rule.

Additionally, the court ruled that the amendment to deduct points if a resident lived outside the island is invalid. The court also said any regulations that are amended must be published in the Government Gazette and announced for public viewing.

The case was filed in court on March 30, 2021, by a resident of Eydhafushi. The island council has not yet announced how it will proceed with the decision of the court.

The last residential land plots from Eydhafushi were allocated in 1989.
